Terms of Service
These Terms of Service ("Terms") are an agreement between you and NyxMarket ("NyxMarket", "we", "us") and govern your access to and use of https://nyxmarket.comand the digital products sold or offered there (the "Service"). By using the Service or buying a product, you agree to these Terms. If you do not agree, please do not use the Service.
1. Eligibility & accounts
You must be at least 16 years old (or the age of digital consent in your country) to use the Service. If you create an account, you are responsible for keeping your credentials secure and for all activity under your account. Provide accurate information and keep it up to date.
2. Products & delivery
We sell digital products — including website templates, browser-based tools, design assets, and similar downloadable files. Products are delivered electronically: after a successful payment (or, for free items, after email verification) you receive a secure download link. No physical goods are shipped. Live previews and screenshots are provided to help you evaluate a product before buying.
3. Pricing & payment
Prices are shown on each product page and may change at any time. Payments are processed securely by Stripe; by purchasing, you agree to Stripe's terms as well. You are responsible for any taxes that apply to your purchase unless we are required to collect them. We may correct pricing errors and cancel affected orders, refunding any amount charged.
4. Licence to use products
When you buy or download a product, we grant you a non-exclusive, worldwide, perpetual licence to use it, subject to these Terms and any licence notes shown on the product page. Unless a product page states otherwise, you may:
- use the product in unlimited personal and commercial projects, including paid client work;
- modify and customise it to suit your needs.
You may not:
- resell, redistribute, sublicense, or give away the product files as-is, or as part of a competing product, template pack, or asset library;
- share your download links or account access publicly;
- claim authorship of the original product or remove included attribution where required;
- use the product for unlawful, infringing, or harmful purposes.
5. Refunds
Because products are digital and delivered instantly, sales are generally final. That said, we offer a good-faith 14-day guarantee: if a product is broken, materially not as described, or you simply aren't satisfied, contact us within 14 days of purchase and we will work with you toward a fix or a refund. 6. Intellectual property
All products, the NyxMarket name and logo, and the content and design of the Service are owned by us or our licensors and are protected by intellectual-property laws. Buying a product grants you the licence in section 4 — it does not transfer ownership or any trademark rights.
7. Acceptable use
You agree not to misuse the Service, including by attempting to:
- access files, accounts, or systems you are not authorised to access;
- circumvent payment, download limits, or security measures;
- disrupt, overload, or reverse-engineer the Service; or
- upload malicious code or use the Service to infringe others' rights.
8. Third-party content & links
Products or pages may reference third-party software, fonts, or demos. Their respective licences and terms apply to those components, and we are not responsible for third-party websites or services.
9. Disclaimers
The Service and all products are provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that products will meet your specific requirements.
10. Limitation of liability
To the maximum extent permitted by law, NyxMarket will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, profits, or revenue, arising from your use of the Service or any product. Our total liability for any claim is limited to the amount you paid for the product giving rise to the claim.
11. Termination
We may suspend or terminate your access if you breach these Terms. Licences granted for products you have lawfully purchased survive termination, subject to the restrictions in section 4.
12. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date shows the latest revision; continued use of the Service after changes means you accept them.
13. Governing law
These Terms are governed by the laws of the country in which the operator is established, without regard to its conflict-of-law rules. Courts located there will have jurisdiction, unless mandatory local consumer-protection laws provide otherwise.
